Website Terms of Use

Effective October 21, 2026.

These Terms of Use (the "Terms") are an agreement between you and Cyberdialect ("Cyberdialect," "we," "us," or "our"). They govern your use of the website at law.cyberdialect.com (the "Site"), including its pages, articles, contact form, and booking calendar.

These Terms cover the Site only. They do not cover the BP Portal application at bp-portal.cyberdialect.com or any paid service. A firm that uses BP Portal does so under a separate written agreement with us, and that agreement, not these Terms, governs the service.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The short version

This summary is here to help you read the rest. Where the two differ, the full Terms control.

  • The Site describes our product. It is not legal advice, and we are not a law firm.
  • Descriptions, prices, and examples on the Site are information, not a contract. The terms of any paid service are in the agreement a firm signs.
  • Please do not send client files, medical records, or other confidential information through the contact form or the booking calendar.
  • Use the Site normally. Do not attack it, scrape it, or misuse the contact form.
  • The Site is provided as is, and our liability for it is limited.
  • New York law governs, and disputes are resolved in New York courts.

1. Using the Site

1.1 Who may use it. The Site is intended for attorneys, law firm staff, and others interested in our product. You must be at least 18 years old to use it.

1.2 Using it on behalf of a firm. If you use the Site on behalf of a law firm or other organization, these Terms apply to you and to that organization.

2. Not legal advice, and not a law firm

2.1 General information only. Everything on the Site, including the articles in the Answers section, is general information about our product and about New York practice. It is not legal advice, and it may be incomplete or out of date. Statutes, rules, and case law change, and we do not promise to update the Site when they do. Do not rely on anything on the Site as a substitute for your own research and professional judgment.

2.2 We are not a law firm. Cyberdialect is a software company. We do not practice law, and nothing on the Site, and no message, call, or demo with us, creates an attorney and client relationship with anyone.

3. Product information is not an offer

3.1 Information, not a contract. Product descriptions, feature lists, prices, trial offers, comparisons, time estimates, and sample documents on the Site describe our product as it stands when you read them. They are not a binding offer, and we may change them at any time without notice. The terms of any paid service, including price, are only those in the written agreement a firm signs with us.

3.2 Examples are examples. Sample documents, comparisons, and statements about time saved reflect particular cases and particular firms. Your results may differ.

4. What you send us through the Site

4.1 Be accurate. When you use the contact form or book a demo, please give accurate information about yourself and your firm.

4.2 Do not send confidential information. Please do not send client files, medical records, Social Security numbers, or other confidential or privileged information through the contact form, the booking calendar, or email before your firm has an agreement with us. Those channels are built for introductions, not case material, and sending us something through them does not create a duty of confidentiality on our part.

4.3 Your ideas. If you send us suggestions or feedback about our product, we may use them without restriction or payment.

4.4 Privacy. Our Privacy Policy explains what information the Site collects, including through analytics and advertising tools, and how it is used.

5. Our content

5.1 Ownership. The Site and its content, including text, articles, graphics, videos, the BP Portal and Cyberdialect names and logos, and the design of the Site, belong to Cyberdialect or its licensors and are protected by copyright, trademark, and other laws.

5.2 What you may do. You may view the Site, share links to it, print or save pages for your own reference or for internal discussion within your firm, and quote short passages with credit and a link back. Any other copying, republishing, or commercial use requires our written permission.

5.3 Copyright concerns. If you believe something on the Site infringes your copyright, email info@cyberdialect.com with a description of the work, where it appears on the Site, and how to reach you, and we will look into it promptly.

6. Acceptable use

When using the Site, you must not:

  • use it in violation of any law
  • try to gain unauthorized access to the Site, its servers, or any connected system, or probe, scan, or test its security without our written permission
  • interfere with its operation, including by overloading it or introducing malware
  • use bots, scrapers, or other automated means to copy its content, including to train AI models, except ordinary search engine indexing
  • send spam, false information, or automated submissions through the contact form or booking calendar
  • frame or mirror the Site, or present its content as your own
  • impersonate anyone or misrepresent your connection to a person or firm

We may block access to the Site for anyone who does. If you find a security weakness, please tell us instead of testing it further.

7. Services and links run by others

The Site embeds and links to services run by others, including the Calendly booking calendar, and uses tools from Google and Meta described in our Privacy Policy. We do not control those services and are not responsible for them. Their own terms and privacy policies apply when you use them.

8. Disclaimers

THE SITE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON INFRINGEMENT, AND ACCURACY. WE DO NOT PROMISE THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, ERROR FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

9. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, CYBERDIALECT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, CLIENTS, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, INCLUDING ANY RELIANCE ON ITS CONTENT, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

These limits do not apply to any liability that the law does not allow to be limited.

10. Your responsibility for misuse

You will defend, indemnify, and hold harmless Cyberdialect and its owners, employees, and contractors from any third party claim, and the resulting losses and reasonable attorney fees, arising from your violation of these Terms or your misuse of the Site.

11. Disputes

11.1 Talk to us first. Before starting any lawsuit about the Site, please send a written description of the problem to info@cyberdialect.com, and we will both try in good faith to resolve it for 30 days.

11.2 Governing law. These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules.

11.3 Where. Any lawsuit arising out of or relating to the Site or these Terms must be brought only in the state courts of New York or the United States District Court for the Eastern District of New York, and you consent to the personal jurisdiction of those courts.

11.4 JURY AND CLASS ACTION WAIVER. TO THE FULLEST EXTENT THE LAW ALLOWS, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL, AND AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, IN ANY LAWSUIT ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS.

11.5 Time limit. To the extent the law allows, any claim arising out of or relating to the Site or these Terms must be brought within one year after it arises, or it is permanently barred.

12. Changes

We may change the Site, or stop offering any part of it, at any time. We may also update these Terms by posting a new version on this page and changing the effective date at the top. The version in effect when you use the Site is the one that applies.

13. General terms

13.1 Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If your firm has a signed agreement with us, that agreement governs the service it covers, and these Terms do not change it.

13.2 Severability and waiver. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest stays in effect. Not enforcing a provision is not a waiver of the right to enforce it later.

13.3 Assignment. We may transfer these Terms in connection with a merger, acquisition, or sale of our business. You may not transfer them without our written consent.

13.4 No third party beneficiaries. These Terms are only for the benefit of you and us.

13.5 Headings and words. Headings are for convenience only. "Including" means "including without limitation."

14. Contact

Questions about these Terms go to Cyberdialect, Long Island, New York, at info@cyberdialect.com or (516) 531-3962.
